Acceptable Use Policy

This Acceptable Use Policy ("AUP") supplements the Terms of Service and governs how you may use Platform. By using the Service, you agree to comply with this AUP in addition to the Terms of Service.
1. Prohibited Products and Services
You may not use Platform to sell, distribute, or promote:
- Weapons, ammunition, explosives, or related accessories
- Narcotics, controlled substances, or drug paraphernalia
- Counterfeit, replica, or knock-off branded goods
- Pirated content or unauthorised copies of digital media
- Tobacco products and e-cigarettes (unless compliant with applicable Indian regulations)
- Pornographic or sexually explicit content
- Gambling services, lotteries, or betting schemes (unless licensed under applicable Indian law)
- Financial instruments, securities, or cryptocurrency without proper licensing from SEBI, RBI, or other applicable regulators
- Products sanctioned under Indian export control laws
- Products or services that violate our payment partners' merchant category restrictions
- Multi-level marketing schemes, pyramid schemes, or Ponzi schemes
- Human remains, body parts, or organs
- Stolen property or goods obtained through illegal means
- Any product or service prohibited under applicable Indian law
This list is illustrative, not exhaustive. Platform reserves the right to determine, at its sole discretion, whether a product or service is prohibited.
2. Fair Use of "Unlimited" Features
Where a plan includes features described as "unlimited", this means generous allowances for normal, legitimate business operations — not infinite or unrestricted consumption.
- "Unlimited products" means a genuine product catalogue for your business, not automated mass-generation of listings for SEO manipulation or other artificial purposes
- "Unlimited staff accounts" means real team members operating your business, not bots, automated agents, or accounts created for non-business purposes
- "Unlimited pages" means genuine content pages for your store, not mass-generated pages
- Platform reserves the right to define and enforce reasonable-use thresholds
- We will contact you before taking any action if your usage approaches our fair-use boundaries
3. Traffic and Resource Limits
Each subscription plan is designed for a specific scale of operations.
- If your store consistently exceeds the expected traffic, bandwidth, storage, or compute resources for your plan tier, we will notify you and recommend an appropriate upgrade
- Sustained resource overuse without upgrading may result in throttling to protect service quality for all merchants
- For stores requiring capacity beyond our published plans, custom enterprise plans are available — contact us for a quote
- Deliberate traffic amplification (e.g., running load tests or stress tests against production infrastructure without prior written authorisation) is prohibited
- Platform may monitor resource usage to ensure equitable service delivery
4. API Usage and Rate Limiting
If your plan includes API access:
- Published rate limits apply to all API endpoints
- You must not attempt to bypass, circumvent, or overwhelm rate-limiting mechanisms
- Scraping Platform APIs, other merchants' storefronts, or any part of the Service is prohibited
- Using API access to build a product that competes with Platform is prohibited
- Automated access must include appropriate identification (User-Agent headers)
5. Content Restrictions
Stores hosted on Platform must not contain:
- Content that promotes hatred, violence, or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic
- Content that infringes third-party intellectual property rights (copyright, trademarks, patents)
- Misleading product claims, fake reviews, or deceptive business practices
- Malicious code, phishing pages, malware, or any content designed to harm users or their devices
- Content that violates the Information Technology Act, 2000 or the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021
6. Email and Communications
- You must not use Platform to send unsolicited commercial communications (spam)
- Transactional emails sent through Platform must comply with applicable laws
- If your plan includes messaging features (e.g., WhatsApp), you must use them in accordance with the respective messaging platform's business policies
- You are responsible for obtaining necessary consents before sending marketing communications to your customers
7. Security
- You must not attempt to gain unauthorised access to Platform's systems, other merchants' stores, or any data you are not authorised to access
- You must not probe, scan, or test the vulnerability of Platform's systems without prior written authorisation
- You must promptly report any security vulnerabilities you discover to security@sailwynd.com
- You must not interfere with or disrupt the Service or the servers and networks connected to it
8. Enforcement and Consequences
Violations of this AUP may result in enforcement actions, which follow a graduated approach depending on severity:
- Warning — For first-time or minor violations, we will notify you by email and require corrective action within 48 hours
- Throttling— For persistent resource overuse, we may reduce your store's traffic capacity or API rate limits until the issue is resolved
- Suspension — For serious violations or failure to correct after a warning, your store may be taken offline. You will have 7 days to appeal the suspension.
- Termination — For severe violations (illegal activity, fraud, repeated offences, or conduct that poses a risk to Platform or other merchants), your account may be terminated immediately. Refund terms for platform-initiated termination apply as described in our Refund Policy.
Platform reserves the right to skip intermediate enforcement steps and proceed directly to suspension or termination for severe violations, at its sole discretion.
9. Modifications
We may update this Acceptable Use Policy from time to time. Material changes will be communicated by email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated AUP.
10. Reporting Violations
If you believe another merchant on Platform is violating this AUP, please report it to legal@sailwynd.com with details of the suspected violation. We review all reports and will take appropriate action.
